A spokesperson for the National Labor Relations Board (NLRB) announced Amazon was hit with an official complaint on Wednesday over its alleged refusal to bargain with a New York workers’ union.

The spokesperson for the labor relations board said the NLRB general counsel, which functions as a sort of prosecutor, would seek potential remedies from Amazon, such as ordering Amazon to bargain with the worker’s union at its JFK8 facility in Staten Island, which filed the complaint.

The president of the union, Chris Smalls said, “I’m pleased to see the NLRB issue this complaint,” and noted the company should negotiate with its employees.

Requests for comment from Amazon were not immediately responded to.

In the first case of its kind for the online retail giant, last year the workers at Amazon’s JFK8 fulfillment facility in Staten Island voted to join the Amazon Labor Union.

In January of this year, Amazon’s attempt to overturn the results of the JFK8 election was rejected by an NLRB official.

Amazon has not bargained with the union yet as it is still challenging the results in front of a US labor board.

As the NLRB complaint was being announced, dozens of New York Amazon warehouse workers filed a suit against the union on Monday, alleging that the top officials in the union were refusing to hold the democratic elections which were required to fill its leadership posts.
